Application Terms of Service for Postpilot

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Postpilot application ("Application") operated by The Last Dance ("us", "we", or "our").

Your access to and use of the Application is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Application.

By accessing or using the Application, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Application.

1. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Application and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. Content

Our Application allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post on or through the Application, including its legality, reliability, and appropriateness.

By posting Content on or through the Application, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Application. You retain any and all of your rights to any Content you submit, post, or display on or through the Application and you are responsible for protecting those rights.

You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Application does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

3. Links to Other Websites

Our Application may contain links to other websites or services that are not owned or controlled by The Last Dance.

The Last Dance has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that The Last Dance shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

4. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Application will immediately cease. If you wish to terminate your account, you may simply discontinue using the Application.

5. Limitation of Liability

In no event shall The Last Dance, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Application; (ii) any conduct or Content of any third party on the Application; (iii) any Content obtained from the Application; and (iv) unauthorized access, use, or alteration of your transmissions or Content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

6. Disclaimer

Your use of the Application is at your sole risk. The Application is provided on an "AS IS" and "AS AVAILABLE" basis. The Application is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

The Last Dance its subsidiaries, affiliates, and its licensors do not warrant that a) the Application will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Application is free of viruses or other harmful components; or d) the results of using the Application will meet your requirements.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Application, and supersede and replace any prior agreements we might have between us regarding the Application.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Application after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Application.

Ketentuan Layanan Aplikasi Postpilot

Harap baca Ketentuan Layanan ini ("Ketentuan", "Ketentuan Layanan") dengan cermat sebelum menggunakan aplikasi Postpilot ("Aplikasi") yang dioperasikan oleh The Last Dance ("kami", "milik kami", atau "milik kami").

Akses dan penggunaan Aplikasi Anda dikondisikan pada penerimaan dan kepatuhan Anda terhadap Ketentuan ini. Ketentuan ini berlaku untuk semua pengunjung, pengguna, dan orang lain yang mengakses atau menggunakan Aplikasi.

Dengan mengakses atau menggunakan Aplikasi, Anda setuju untuk terikat oleh Ketentuan ini. Jika Anda tidak setuju dengan bagian mana pun dari ketentuan tersebut, maka Anda tidak boleh mengakses Aplikasi.

1. Akun

Saat Anda membuat akun dengan kami, Anda harus memberikan informasi yang akurat, lengkap, dan terkini setiap saat. Kegagalan untuk melakukannya merupakan pelanggaran Ketentuan, yang dapat mengakibatkan penghentian segera akun Anda di Layanan kami.

Anda bertanggung jawab untuk menjaga kata sandi yang Anda gunakan untuk mengakses Aplikasi dan untuk setiap aktivitas atau tindakan di bawah kata sandi Anda, apakah kata sandi Anda dengan Layanan kami atau layanan pihak ketiga.

Anda setuju untuk tidak mengungkapkan kata sandi Anda kepada pihak ketiga mana pun. Anda harus segera memberi tahu kami setelah mengetahui adanya pelanggaran keamanan atau penggunaan akun Anda yang tidak sah.

2. Konten

Aplikasi kami memungkinkan Anda untuk memposting, menautkan, menyimpan, berbagi, dan menyediakan informasi, teks, grafik, video, atau materi lainnya ("Konten"). Anda bertanggung jawab atas Konten yang Anda posting di atau melalui Aplikasi, termasuk legalitas, keandalan, dan kesesuaiannya.

Dengan memposting Konten di atau melalui Aplikasi, Anda memberikan kami hak dan lisensi untuk menggunakan, memodifikasi, melakukan secara publik, menampilkan secara publik, mereproduksi, dan mendistribusikan Konten tersebut di dan melalui Aplikasi. Anda mempertahankan setiap dan semua hak Anda atas Konten apa pun yang Anda kirimkan, posting, atau tampilkan di atau melalui Aplikasi dan Anda bertanggung jawab untuk melindungi hak-hak tersebut.

Anda menyatakan dan menjamin bahwa: (i) Konten adalah milik Anda (Anda memilikinya) atau Anda memiliki hak untuk menggunakannya dan memberikan kami hak dan lisensi sebagaimana diatur dalam Ketentuan ini, dan (ii) posting Konten Anda di atau melalui Aplikasi tidak melanggar hak privasi, hak publisitas, hak cipta, hak kontrak, atau hak lainnya dari setiap orang.

3. Tautan ke Situs Web Lain

Aplikasi kami mungkin berisi tautan ke situs web atau layanan pihak ketiga yang tidak dimiliki atau dikendalikan oleh The Last Dance.

The Last Dance tidak memiliki kendali atas, dan tidak bertanggung jawab atas, konten, kebijakan privasi, atau praktik situs web atau layanan pihak ketiga mana pun. Anda selanjutnya mengakui dan menyetujui bahwa The Last Dance tidak akan bertanggung jawab atau berkewajiban, secara langsung atau tidak langsung, atas kerusakan atau kerugian yang disebabkan atau diduga disebabkan oleh atau sehubungan dengan penggunaan atau ketergantungan pada konten, barang, atau layanan apa pun yang tersedia di atau melalui situs web atau layanan tersebut.

4. Penghentian

Kami dapat menghentikan atau menangguhkan akun Anda segera, tanpa pemberitahuan atau kewajiban sebelumnya, untuk alasan apa pun, termasuk tanpa batasan jika Anda melanggar Ketentuan.

Setelah penghentian, hak Anda untuk menggunakan Aplikasi akan segera berhenti. Jika Anda ingin menghentikan akun Anda, Anda dapat berhenti menggunakan Aplikasi.

5. Batasan Tanggung Jawab

Dalam keadaan apa pun The Last Dance, direktur, karyawan, mitra, agen, pemasok, atau afiliasinya tidak akan bertanggung jawab atas kerugian tidak langsung, insidental, khusus, konsekuensial, atau hukuman, termasuk tanpa batasan, kehilangan keuntungan, data, penggunaan, niat baik, atau kerugian tidak berwujud lainnya, yang dihasilkan dari (i) akses Anda ke atau penggunaan atau ketidakmampuan untuk mengakses atau menggunakan Aplikasi; (ii) perilaku atau Konten pihak ketiga mana pun di Aplikasi; (iii) Konten yang diperoleh dari Aplikasi; dan (iv) akses, penggunaan, atau perubahan transmisi atau Konten Anda yang tidak sah, baik berdasarkan garansi, kontrak, tort (termasuk kelalaian), atau teori hukum lainnya, apakah kami telah diberitahu tentang kemungkinan kerusakan tersebut atau tidak, dan bahkan jika ditemukan bahwa upaya perbaikan yang ditetapkan di sini telah gagal dari tujuan esensialnya.

6. Penafian

Penggunaan Aplikasi adalah risiko Anda sendiri. Aplikasi disediakan atas dasar "SEBAGAIMANA ADANYA" dan "SEBAGAIMANA TERSEDIA". Aplikasi disediakan tanpa jaminan dalam bentuk apa pun, baik tersurat maupun tersirat, termasuk, namun tidak terbatas pada, jaminan tersirat tentang kelayakan untuk diperdagangkan, kesesuaian untuk tujuan tertentu, non-pelanggaran, atau kinerja.

The Last Dance anak perusahaan, afiliasi, dan pemberi lisensinya tidak menjamin bahwa a) Aplikasi akan berfungsi tanpa gangguan, aman, atau tersedia pada waktu atau lokasi tertentu; b) setiap kesalahan atau cacat akan diperbaiki; c) Aplikasi bebas dari virus atau komponen berbahaya lainnya; atau d) hasil penggunaan Aplikasi akan memenuhi persyaratan Anda.

7. Hukum yang Mengatur

Ketentuan ini akan diatur dan ditafsirkan sesuai dengan hukum Indonesia, tanpa memperhatikan pertentangan ketentuan hukumnya.

Kegagalan kami untuk menegakkan hak atau ketentuan apa pun dari Ketentuan ini tidak akan dianggap sebagai pengabaian hak-hak tersebut. Jika ada ketentuan dari Ketentuan ini yang dianggap tidak valid atau tidak dapat dilaksanakan oleh pengadilan, ketentuan lainnya dari Ketentuan ini akan tetap berlaku. Ketentuan ini merupakan keseluruhan perjanjian antara kami mengenai Aplikasi kami, dan menggantikan serta menggantikan setiap perjanjian sebelumnya yang mungkin kami miliki antara kami mengenai Aplikasi.

8. Perubahan Ketentuan

Kami berhak, atas kebijakan kami sendiri, untuk memodifikasi atau mengganti Ketentuan ini kapan saja. Jika revisi adalah materi, kami akan mencoba memberikan pemberitahuan setidaknya 30 hari sebelum ketentuan baru berlaku. Apa yang merupakan perubahan materi akan ditentukan atas kebijakan kami sendiri.

Dengan terus mengakses atau menggunakan Aplikasi kami setelah revisi tersebut menjadi efektif, Anda setuju untuk terikat oleh ketentuan yang direvisi. Jika Anda tidak setuju dengan ketentuan baru, secara keseluruhan atau sebagian, harap berhenti menggunakan situs web dan Aplikasi.
